1. Agreement to Terms

By accessing or using the ShiftPing mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the App.

ShiftPing is operated by Martin Lorentzen ("we," "us," or "our"). The App provides team communication and shift notification services for businesses and organizations.

2. Description of Service

ShiftPing is a team communication and shift management application that allows users to:

• Create and manage teams
• Send mass notifications to team members
• Organize and schedule shifts
• Coordinate team activities
• Manage team invitations and requests

3. User Accounts

3.1 Account Creation

To use certain features of the App, you must create an account by providing:

• Your name
• Email address
• Phone number
• Other required information

3.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

3.3 Account Requirements

You must:

• Provide accurate and complete information
• Keep your account information up to date
• Not share your account with others
• Have the legal capacity to enter into binding contracts

4. User Conduct

You agree not to:

• Use the App for any illegal purpose or in violation of any laws
• Harass, abuse, or harm other users
• Send spam, unsolicited messages, or chain letters
• Impersonate any person or entity
• Interfere with or disrupt the App or servers
• Attempt to gain unauthorized access to the App or related systems
• Use automated systems to access the App without permission
• Collect or harvest information about other users
• Post or transmit any content that is unlawful, harmful, or offensive

5. Subscriptions and Payments

5.1 Subscription Plans

ShiftPing may offer various subscription plans with different features and pricing. Details of available plans are provided within the App.

5.2 Billing

By purchasing a subscription, you agree to pay the fees specified for your chosen plan. Subscriptions are billed on a recurring basis (monthly or annually) and will automatically renew unless cancelled.

5.3 Payment Processing

Payments are processed through third-party payment processors (Apple App Store, Google Play Store, or RevenueCat). Your use of these payment services is subject to their terms and conditions.

5.4 Refunds

Refund policies are governed by the respective app store policies (Apple App Store or Google Play Store). We do not provide direct refunds for in-app purchases.

5.5 Cancellation

You may cancel your subscription at any time through your app store account settings. Cancellation will take effect at the end of your current billing period.

5.6 Price Changes

We reserve the right to modify subscription prices. Price changes will be communicated to you in advance and will apply to subsequent billing periods.

6. Team Management

6.1 Team Creation

Users may create teams and invite other users to join. Team creators ("Admins") have additional responsibilities and controls.

6.2 Admin Responsibilities

Team Admins are responsible for:

• Managing team members and permissions
• Content posted within their team
• Compliance with these Terms by team members
• Maintaining appropriate use of the App within their team

6.3 Team Content

Content shared within teams is the responsibility of the users who post it. We are not responsible for user-generated content within teams.

7. Push Notifications

By using ShiftPing, you may receive push notifications. You can manage notification settings through your device settings or within the App. We are not responsible for notifications that you receive as a result of actions by other users (such as team admins sending notifications to team members).

8. Intellectual Property

8.1 Our Rights

The App, including its design, features, and content, is owned by us and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our permission.

8.2 Your Content

You retain ownership of content you submit through the App. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and display your content as necessary to provide the service.

9. Privacy

Your use of the App is also governed by our Privacy Policy. Please review the Privacy Policy to understand how we collect, use, and protect your information.

10. Third-Party Services

The App may integrate with third-party services, including:

• Firebase (authentication, database, cloud functions)
• RevenueCat (subscription management)
• Apple and Google services (push notifications, in-app purchases)

Your use of these services is subject to their respective terms and privacy policies.

11. Disclaimers

11.1 Service Availability

The App is provided "as is" and "as available." We do not guarantee that the App will be:

• Available at all times or without interruption
• Free from errors or defects
• Secure or safe from unauthorized access
• Compatible with all devices or operating systems

11.2 No Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM
• WE ARE NOT RESPONSIBLE FOR ANY LOSS OR DAMAGE CAUSED BY YOUR USE OF THE APP

13. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another user or third party
• Content you submit through the App

14. Termination

14.1 By You

You may stop using the App at any time by deleting your account or uninstalling the application.

14.2 By Us

We may suspend or terminate your access to the App at any time, with or without notice, for:

• Violation of these Terms
• Illegal activity
• Fraudulent or harmful behavior
• Extended periods of inactivity
• Any other reason at our discretion

14.3 Effect of Termination

Upon termination:

• Your right to use the App will immediately cease
• We may delete your account and content
• You will not be entitled to any refund for unused subscription time

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes by:

• Posting a notice in the App
• Sending an email to your registered email address
• Updating the "Last updated" date at the top of this page

Your continued use of the App after changes are made constitutes acceptance of the modified Terms.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of your jurisdiction. Any disputes arising from these Terms or your use of the App shall be resolved through:

• Good faith negotiation
• If negotiation fails, binding arbitration or mediation as applicable in your jurisdiction

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of the App.
